Privacy Policy

This Privacy Policy ("Policy") is an integral part of the "Terms of Use" and aims to clarify how iEducate collects, uses, shares, and/or stores the Personal Data of its Users.

The concepts of "Teachers", "Visitors", "Users", "Support", "Personal Data", and all others have the same meaning expressed in the Terms of Use.

1. HOW IS YOUR PERSONAL DATA USED?

The hypotheses for the lawful processing of data are listed in art. 7 of Law 13.709/18 ("Brazilian General Data Protection Law" - LGPD) and are referenced in the "Legal Basis" column.

Below is the enumeration of Personal Data collected according to the User's category, the purpose of collecting the data, and the legal basis under which it is processed:

iEducate monitors Visitor traffic to its website and application to learn about its target audience for the purpose of improving its communication with them.

To carry out the Provision of the contracted Services, iEducate needs: (i) the Teacher's name, email, and IP address to identify them, ensure their secure access to the platform, and the stability of the services provided; (ii) to know the subjects taught by its Teachers, so as to meet their need; (iii) to have access to all content stored by the teacher on the platform (including materials, files, assessments, etc.) to enable content processing, perform backups, conduct statistical analyses and quality control, and provide technical support; and (iv) generally, to monitor all interaction of Teachers with the platform, in order to assist their work.

iEducate does not disclose the Teacher's personal data to third parties without their consent, except in cases of legal requirement (request from the Judiciary, for example), or for its own defense in arbitral, administrative, or judicial proceedings under the terms of art. 7, VI of the Brazilian General Data Protection Law.

iEducate may use data extracted from the Teacher's interaction with the platform to improve its services. In this case, all data is anonymized and is no longer considered personal data, under the terms of art. 12 of the Brazilian General Data Protection Law.

To issue invoices and process payments, iEducate needs to collect extra data from its Premium Teachers, such as full name, CPF, and credit card information (if this is the payment method chosen by the Teacher).

2. DOES iEducate USE COOKIES?

A cookie is a small text file stored in your browser by a web server. Cookies contain information that can be read later by a web server in the domain that issued the cookie to you. Such information is used, above all, to make the website work correctly.

iEducate and its partner service providers use cookies to ensure that their Users have the best possible experience. Some cookies are essential for the operation of iEducate's websites; others are used to analyze traffic on such sites. Some of the cookies will only be used if you use certain features or select certain preferences.

The User may, at any time, restrict or even disable the use of cookies by iEducate through their browser settings. Keep in mind, however, that disabling certain cookies may affect the quality of the services offered by iEducate.

3. WITH WHOM DOES iEducate SHARE YOUR DATA?

iEducate may share Teachers' data with partner companies responsible for inhibiting malicious attacks against our technology, in order to preserve access security and the stability of services to the Teachers themselves.

Data referring to payments will also be shared with the partner companies responsible for payment processing, invoice issuance, and iEducate's accounting.

iEducate may also share data with third parties (including, but not limited to, attorneys) for the defense of its rights in judicial, administrative, or arbitral proceedings.

All of iEducate's partner companies undertake the contractual commitment to preserve the confidentiality of the information provided by our Users, without prejudice to applicable legal obligations.

4. WHERE, HOW, AND FOR HOW LONG IS YOUR DATA STORED BY iEducate?

The Teachers' data will be stored by iEducate for as long as the contractual relationship lasts and there is no request for deletion or revocation of consent, under the terms of article 9, item II, of the Brazilian General Data Protection Law.

Considering that consent is indispensable for the provision of the service, withdrawing consent also implies the cancellation of the contract with iEducate.

Upon canceling the service, all information about the Teacher will be irreparably deleted, including all of their stored files, including their materials, files, and entire history of interaction with the platform. However, data that iEducate has a legal obligation to retain may be preserved, such as those contained in invoices.

Visitor data will be stored for a period of 14 (fourteen) months.

Anonymized data is not considered personal data, under the terms of article 12 of the LGPD, and is not subject to the provisions of this Privacy Policy or to the LGPD.

The data collected from Users may be stored in data centers or local infrastructure. The data centers may be third-party infrastructure or cloud located in the United States or any other location.

For security reasons, iEducate does not disclose the location of the data centers or of its local infrastructure.

5. WHAT ARE THE RIGHTS OF THE DATA SUBJECT WHOSE PERSONAL DATA IS STORED BY iEducate?

The User will always have rights regarding privacy and the protection of their Personal Data, as described below:

Right to object to the processing of Personal DataThe User may object to the processing of their Personal Data, but, in this case, the provision of iEducate's services will not be possible.
Request portabilityiEducate will provide the User with a copy of their Personal Data in a structured and interoperable format.
Right to withdraw consent at any timeThe withdrawal of consent by the User does not affect the legality of any processing carried out before the date on which it was communicated to iEducate. It will not be possible to continue iEducate's service after the withdrawal of consent.

6. HOW DOES iEducate PROTECT YOUR PERSONAL DATA?

iEducate protects your Personal Data against loss, unauthorized use, or access.

To prevent data loss, iEducate makes spare copies of the data (backup) and stores them in a secure location.

iEducate restricts data access to personnel (employees and third parties) essentially necessary for the provision of the service, all of whom are contractually bound to the commitment to preserve the confidentiality of information.

Without prejudice, iEducate monitors all employees and third parties who access Users' personal data, in order to prevent improper use.

iEducate also conducts periodic inspections of its equipment and monitors access to its platforms/applications in order to prevent malicious access by unauthorized third parties.

7. DOES iEducate TRANSFER YOUR PERSONAL DATA ABROAD?

The Internet is a global tool and iEducate's services may be accessed from anywhere in the world. Therefore, if the User is located abroad, they should check the local legislation regarding the privacy of their information.

iEducate may transfer collected personal data outside Brazil, especially if the company responsible for hosting their information is located in foreign territory.

Any transfer of data outside Brazil will be made to locations and companies that ensure adequate levels of data protection. All transfers are encrypted.

8. HOW DOES iEducate INFORM ABOUT UPDATES TO THE PRIVACY POLICY?

iEducate may change the content of this Privacy Policy at any time, according to the purpose or need, such as for adequacy and legal compliance with provisions of law or norms with equivalent legal force, with our User responsible for checking it whenever they access iEducate's websites and applications.

Should there be significant updates to this document that require a new collection of consent, iEducate will notify the User through tools available on its websites and applications or via the contact email provided by the User.

iEducate recommends that you periodically visit this page to be aware of modifications.

9. WHAT LAW APPLIES TO THIS PRIVACY POLICY?

This privacy policy is subject to the laws of the Federative Republic of Brazil, particularly the LGPD. Any disputes will be resolved in the User's domicile court or, if they do not have domicile in Brazil, in the court of Rio de Janeiro/RJ.
